We attach great importance to the transparent handling of personal data. This privacy policy provides information on which personal data we collect, for what purpose and to whom we disclose it. To ensure a high level of transparency, this privacy policy is regularly reviewed and updated.

3. Standard guidelines

3.1 What data is collected from you and who provides this data

Primarily, any personal data that you provide to us or that we collect when operating our website is processed by us. We may also receive personal data about you from third parties. This may include:

  • Personal reference data (Name, address, D.o.B. etc.)
  • Contact data (mobile number, e-mail adrdess etc.)
  • Financial data (e.g. bank account details)
  • Online indicators (e.g. cookie identifiers, IP addresses) 
  • Location and location data
  • Sound and image recordings
  • sensitive data (e.g. biometric data or health information).

3.2 Under which conditions do we process your data?

We treat your data confidentially and in accordance with the purposes set out in this privacy policy. We ensure transparent and appropriate processing.

In exceptional cases where we are not in a position to comply with these principles, data processing may still be permissible due to legitimate justification. Possible grounds for lawful processing include in particular:

  • your consent has been given
  • fulfilment of a contract or pre-contractual provisions 
  • our legitimate interests, unless your interests override ours

3.3 How can you withdraw consent?

If you have given us your consent to process your personal data for specific purposes, we will process your data within the terms of this consent unless we have another justification.

You can withdraw your consent at any time by sending an e-mail to the address provided in the legal notice. Data processing that has already taken place remains unaffected.

3.4 Under which circumstances can we pass on your data to third parties?

a. General principle

We may need to use the services of third parties or affiliated companies and commission them to process your data (so-called processors). The categories of data recipients are as follows:

  • Bookkeeping, accountancy and auditing companies;
  • Consultancy firms (legal advisory services, taxes, etc.);
  • IT service providers (web hosting, support, cloud services, website design, etc.);
  • Payment service providers;
  • Providers of tracking, conversion and advertising services.

We ensure that these third parties and any affiliated companies comply with the requirements of data protection and treat your personal data confidentially.

We may also be obliged to disclose your personal data to authorities.

b. Accessing our social media channels

Links to our social media channels may be embedded on our website. This is always clearly indicated – typically by corresponding icons. By clicking on the icons, the user will be redirected to our social media channels.

In this case, social media providers are informed that you are accessing their platform from our website. The social media providers can use the data collected in this way for their own purposes. We would like to point out that we are not aware of the content of the transmitted data or its use by the operators.

c. International data transfer

Under certain circumstances, your personal data may be transferred to companies in other countries as part of order processing. These companies are bound by the same data protection regulations applicable to us. The transfer may take place worldwide.
Should the level of data protection not correspond to that in Switzerland, we conduct a prior risk assessment and ensure contractually that the same level of protection is guaranteed as in Switzerland (e.g. by means of the new standard contractual clauses of the EU Commission or other legally defined measures). In the event that this risk assessment is not favourable, we put additional technical measures in place to protect your data. 3.5 How long do we store data?

Personal data is only stored for as long as is necessary to fulfil the individual purposes for which the data was collected.
Data collected when visiting our website is stored for twelve months. The exception is analysis and tracking data, which may be stored for longer.
Contract data is stored for longer, due to legal obligations. We are obliged to store business communications, completed contracts and accounting documents for up to 10 years. Insofar as we no longer require client data for the provision of services, the data will be blocked, and we will only use it for accounting and tax purposes.

3.6 How is your data protected?

All data will be stored securely, and all reasonable measures will be taken to protect against loss, access, misuse or alteration.
All contractual partners and employees who have access to personal data are obliged to comply with data protection regulations. It may be necessary in certain circumstances to pass on enquiries to our affiliated companies which will also treat the data confidentially.
We use the SSL (Secure Socket Layer) method on our website in conjunction with the highest level of encryption supported by your browser.

3.7 Your rights

a. Right to information

You can request information about personal data we have stored about you at any time. Please send your request for information together with proof of identity to welcome@evoccoaching.ch.

You also have the right to receive your data in a standard file format if we process your data automatically and if:

  • you have given your consent to the processing of this data    or
  • you have disclosed data in connection a contract entered into or fulfilled.

We may restrict or refuse to provide information or data if this conflicts with our legal obligations, our own legitimate interests, public interests or the interests of a third party. 

The processing of your application is subject to the statutory processing period of 30 days. This period may, however, be extended due to a high volume of enquiries, for legal or technical reasons or because more detailed information is required from you. You will be advised of the extension in timely manner, at least in text form.

b. Deletion and amendment

You have the option of requesting the deletion or amendment of your data at any time. We may reject the request if statutory provisions oblige us to store the data for a longer period or to store it unchanged or if your request conflicts with a legal authorisation.

Please note that exercising your rights may be in conflict with contractual agreements and have corresponding effects on the execution of the contract (e.g. premature cancellation of the contract or financial consequences).

c. Legal Redress

In the event that the processing of personal data adversely impacts you, you are entitled to pursue your rights in court or to file a complaint with the appropriate supervisory authority. 3.8 Changes to the privacy policy

This privacy policy may be amended at any time. Any changes will be made public, and you will not be informed separately.

4. Individual data processing operations

4.1 Website provision and creation of log files

What information do we receive and how is it used?

Certain data is automatically stored on our servers or on servers of services and products that we purchase and/or have installed when you visit for the purposes of system administration, statistics, security or tracking. This concerns:

  • the name of your internet service provider
  • the IP address (under certain circumstances)
  • browser software version
  • the operating system of the computer used to access the URL
  • the date and time of access
  • the website from which you visit the URL
  • the search terms you used to find the URL

What is the reason for processing data?

This data cannot be assigned to a specific person and is not merged with other data sources. The log files are stored in order to guarantee the operation of the website and to safeguard the security of our information technology systems, which constitutes our legitimate interest.

Preventing data collection

The data is only stored for as long as is necessary to fulfil the purpose for which it was collected. Accordingly, the data is deleted at the end of each session. The storage of log files is essential for the operation of the website and therefore there is no possibility for an objection.

4.2 Google Fonts API

We use Google Fonts API on our website, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; ‘Google’), to integrate fonts. By integrating these fonts, a connection is established between your browser and the Google servers when you visit our website in order to download the fonts and display them correctly.
Data, specifically your IP address and information about the browser you are using, may be transmitted to Google through this connection and stored on Google servers. These servers may be located in the USA or other countries.

If you wish to prevent the transfer of data as part of the Google Fonts API, you can block access to the domain fonts.googleapis.com in your browser settings. Please note that as a result, our website may not be displayed correctly.

4.3 Google Hosted Libraries

We use Google Hosted Libraries on our website, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; ‘Google’). Google Hosted Libraries enables us to load certain libraries (e.g. JavaScript libraries) directly from the Google servers in order to optimise the loading times of our websites and ensure consistent performance.
The use of Google Hosted Libraries means that your browser will establish a connection to the Google servers when accessing our website in order to download the required libraries. Data, in particular your IP address and information about the browser used, may be transmitted to Google and stored on Google servers. These servers may be located in the USA or other countries.

If you wish to prevent data transmission within the scope of Google Hosted Libraries, you can block access to the domain ajax.googleapis.com in your browser settings. Please note that this may result in our website not being displayed correctly or that it may take longer to load.

4.4 Google Maps

This website uses Google Maps, a map service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; ‘Google’). Google Maps enables us to integrate interactive maps directly into the website and allows you to conveniently use the map function, for example to search for a location or to plan your journey.
Google receives the information that you have accessed the corresponding subpage of our website when you access the website. Further data, including your IP address, is transmitted to Google and stored on Google servers. These servers may be located in the USA or other countries. This occurs regardless of whether or not Google provides a user account through which you are logged in.

Google stores your data as usage profiles and uses them for the purposes of advertising, market research and/or customising its website. Such an analysis is carried out in particular (even for users who are not logged in) to provide customised advertising.
To exercise your right to object to the creation of these user profiles, it is necessary to contact Google.

BrainBox Generators

BrainBox Generators is a service provided by BrainBox Solutions GmbH to identify all relevant data protection services on a website and to assist with the creation of the privacy policy, among other things. No personal data is collected or processed in the process.
